Currently the Typeable checks are in tcInstDecls1 in [source:compiler/typecheck/TcInstDcls.lhs]; but a more proper place would be in checkValidInstHead in [source:compiler/typecheck/TcValidity.lhs]. Why file a ticket and not just do it? One question straight off: in the comment on SourceNote (which is good, BTW), you wrote results of annotated code *must* be invariant against changes to all source code *except* the spans referenced in the source notes. But surely the value of an expression depends on the values of its free variables?
