If it's OK in HEAD (is it?) I'd be inclined to leave it. The ASSERT is very conservative, so it's very unlikely to reveal a real bug
I'll check if HEAD fixes it. It might reveal a bug - it's from our codebase and there is a random compilation failure that goes away when compilation is restarted.
